CONSTITUTION OF ORISSA GEOLOGICAL SERVICE ASSOCIATION

 

 

Article

 

1.

 

NAME OF THE ASSOCIATION

 

 

 

 

 

The name of the Association shall be “Orissa Geological Service Association” (OGSA).

 

 

 

2.

 

LOCATION OF OFFICE

 

 

 

 

 

The office of the Association shall be located at Bhubaneswar (Hqs.).

 

 

 

3.

 

AIMS AND OBJECTIVES OF ASSOCIATION

 

(1)

To promote solidarity of profession and to diffuse useful knowledge and goodwill among its members

 

(2)

To promote and cultivate the best interest of profession

 

(3)

To protect and safeguard the interest, right, privilege and dignity of its members

 

(4)

To improve the service conditions of its members

 

(5)

To promote academic and cultural activities among the members by keeping in touch with similar societies and eminent personalities

 

 

 

4.

 

MEMBERSHIP

 

(1)

All officers of the Geological Survey and Exploration Wing  [Geologists, Petrologists, Geophysicists, Deputy Director Geology, Joint Director Geology (L-II), Joint Director Geology (L-I) etc.] of existing Mining and Geology cadre of Orissa including those on deputation or extraordinary study leave shall be eligible for the membership of the Association. Adhoc employees will not be the members of the Association.

 

 

 

 

(2)

Application for membership in the prescribed proforma shall be submitted to General Secretary of the Association who shall enrol the members after ascertaining the eligibility.  Every applicant shall be deemed to have gone through these rules and have agreed to abide by them.

 

 

 

5.

(1)

CESSATION OF MEMBERSHIP

 

 

A member of this Association shall cease to continue as such if he/ she quits Government service by resignation/ retirement/ removal/ dismissal or death.

 

(2)

DISQUALIFICATION OF MEMBERSHIP

 

 

Any member may be disqualified for membership of the Association if he/ she

 

 

a.      involves/ indulges himself or herself in anti-association activities which shall be considered by the General Body detrimental to common cadre/ interest of members of the Association.

 

 

b.     and for that issue the General Body or the Special General Body meeting of Association convened for the purpose shall be empowered to remove/disqualify any member for breach/ infringement of any provision(s) of the Association taking a two-third majority among the members present, provided that more than fifty percent of the total members remain present in the said meeting.  Further provided that the alleged person should be given adequate opportunity to explain before the said meeting.

 

(3)

RESTORATION OF MEMBERSHIP

 

 

a.     Membership disqualified under Clause 2 of Article 5 can be restored in case it is in the opinion of the General Body that he/ she is fit to be taken as a member for the interest of the Association.

b.     In no case the membership can be restored if it comes under the purview of Clause 1 of Article 5 of the Constitution.

 

 

 

6.

 

SUBSCRIPTION

 

 

To become a life member one has to pay annual subscription by 30th June of each year at the rate of Rs.200/- (Rupees two hundred) only per year for seven consecutive years or can make an one time payment of Rs.1000/- (Rupees one thousand) only. The admission fee for members shall be Rs.50/- (Rupees fifty) only payable at the time of application.

 

 

 

7.

 

FUNDS OF THE ASSOCIATION AND ITS UTILISATION

 

(1)

The funds will include membership subscription, donation and aid, if any, from Government/members of the Association.

 

(2)

The fund will be deposited in a Nationalised Bank in a joint Account which shall be operated by General Secretary and Treasurer.

 

(3)

They can keep with them an impressed money of not exceeding Rs.500/- (Rupees five hundred) only to meet the day to day expenses regarding  the business of the Association.

 

(4)

The funds shall be utilised for furthering the objectives of the Association.

 

(5)

The annual expenditure of the Association must be well within the annual income for the year.

 

 

 

8.

 

YEAR OF ASSOCIATION

 

 

The year of Association shall be from 1st day of August of one calendar year to the 31st day of July of next calendar year.

 

 

 

9.

 

PRIVILEGES OF MEMBERS

 

(1)

To speak in the General Body Meeting or Special General Body Meeting of the Association.

 

(2)

To send proposals for inclusion in the agenda for discussion in the meeting.

 

(3)

To vote on matters considered in all such meetings.

 

(4)

To participate in the cultural activities of the Association.

 

 

 

10.

 

GENERAL BODY MEETING

 

(1)

The supreme authority of the Association shall be vested on the General Body of the Association. Each member shall have one vote.

 

(2)

All matters brought before the General Body Meeting shall be decided by majority of votes and in case of equality of votes, the President shall have to cast a vote.

 

(3)

Notice regarding agenda, date, time and place for discussion in the Annual General Body Meeting shall be sent to all members at last a fortnight before the date fixed for the meeting by the General Secretary.

 

 

 

11.

 

QUORUM

 

 

One-third of the total members present in person shall constitute the quorum of the General Body meeting (Annual General Body/ Special General Body).

 

 

 

 

 

In case of want of quorum the meeting shall be adjourned to a date as decided by Executive Committee and any resolution thereafter cannot remain undecided  and shall be passed by three fourth of the members present.

 

 

 

12.

 

ANNUAL GENERAL BODY MEETING

 

 

Annual General Body Meeting shall be held each year for the following.

 

(1)

To consider and adopt the proceedings of the last meeting along with the statement of Accounts and balance sheet presented by the General Secretary/Treasurer

 

(2)

To pass the Budget for the next year

 

(3)

To modify the policies of the Association, if required

 

(4)

To alter the rate of subscription, if necessary

 

(5)

To elect the Office-bearers of the Association

 

(6)

To listen appeals, if any, against the decision of the Executive Committee

 

(7)

To appoint qualified Auditor for auditing of Accounts

 

(8)

To formulate programmes for next year

 

(9)

To transact any other business incidental to such meeting

 

 

 

13.

 

SPECIAL GENERAL BODY MEETING

 

 

A Special General Body Meeting of the Association may be held after twenty days of issue of notice when Executive Committee deems it necessary or on written requisition from not less than twenty percent of members including five percent from Zones. The requisition shall be addressed to General Secretary who shall place it before Executive Committee to convene the Special General Body Meeting as soon as possible. In case of emergency the above requisition can be addressed to the President who will take immediate steps to convene the Special General Body Meeting with the approval of Executive Committee. The Special General Body Meeting shall have the powers of the Annual General Body Meeting.

(1)

EXECUTIVE COMMITTEE

 

 

a.     The Executive Committee shall consist of (1) President, (2) Vice-President, (3) General Secretary, (4) Secretary (Technical), (5) Joint Secretary (Headquarters), (6) Joint Secretary (Organisation), (7) Treasurer and (8) Executive Committee Members (nine, i.e., three from Hqs. & one each from six zones such as Berhampur, Bolangir, Dhenkanal, Keonjhar, Koraput & Sambalpur Zone).

b.     General Body can nominate two Special Invitees (without voting power) from among the members.

c.     Vice-President and Joint Secretary (Organisation) shall be elected from among members of Zones (Other than Hqs.).

d.     All business of the Association shall be conducted by Executive Committee. Executive Committee may also invite any other member of the Association to attend the Executive Committee meeting as a Special Invitee.

e.     All members of the Executive Committee except the Special Invitee(s) shall have the right to vote.

f.        Ordinarily the members of the Executive Committee shall retire after one year of election or at the annual General Body Meeting.

g.     The actual bus-train fair shall be borne by the Association for the to and fro journey of the Executive Committee members in order to attend the Executive Committee Meeting. Similar facilities will be admissible to the nominee of Executive Committee to visit different zones for the interest of Association.

h.    An elected member of the Executive Committee shall be deemed to have ceased from his Office if he/she fails to attend three consecutive meetings without reasonable ground.

i.       The vacancy of a member of the Executive Committee can be filled up by means of nomination by Executive Committee.

j.         There should be at least two Executive Committee Meetings in a year.

 

 

 

 

(2)

ADVISORY BOARD

 

 

There shall be an Advisory Board consisting of five members nominated by General Body which will be valid till next Annual General Body Meeting. They can advise the Executive Committee when requested. They can attend Executive Committee Meeting as Special Invitees but can not participate in voting.

 

 

 

15.

 

QUORUM IN EXECUTIVE COMMITTEE MEETING

 

 

One-third members will form the quorum in the Executive Committee Meeting. All issues shall be decided by a majority of votes and in case of equality of votes, the President shall have to cast a vote.

 

 

 

16.

 

POWERS AND FUNCTIONS OF EXECUTIVE COMMITTEE

 

(1)

To arrange for Annual and Special General Body Meetings whenever necessary

 

(2)

To carry out the direction of the General Body and implement the resolutions passed in Executive Committee

 

(3)

Preparation of annual Accounts statement and annual report for presentation before Annual General Body Meeting

 

(4)

To take steps for auditing of Accounts by a qualified Auditor and to approve the Accounts maintained by Treasurer

 

(5)

To represent any matter related to the interest of the Association before higher authorities for common benefit of the Association

 

(6)

Executive Committee is answerable to General Body.

 

(7)

To transact all business incidental to the management, aims and objectives of Association

 

 

 

17.

 

ELECTION OF OFFICE-BEARERS/ EXECUTIVE COMMITTEE MEMBERS

 

(1)

Election shall be held during Annual General Body Meeting.

 

(2)

Presiding officer shall be appointed by the Executive Committee to conduct the election.  The appointment should be given to him/ her who would not intend to be a candidate for any office.

 

(3)

Election of Office-bearers and Executive Committee Members, when contested shall be by secret ballot.  Three Executive Committee Members from the members of Headquarters (Bhubaneswar) and six Executive Committee Members from the members of respective six zones shall be elected.

 

(4)

In the event of a single nomination for any Office, Presiding Officer can declare the candidate elected uncontested.

 

(5)

All members excepting those holding administrative posts shall be eligible to file nomination for any of the posts of the Executive Committee.

 

(6)

On completion of voting, the ballot papers shall be counted by Presiding Officer in presence of candidates or their representatives.

 

(7)

On completion of the counting the Presiding Officer shall announce the result.

 

 

 

18.

 

DUTIES AND RESPONSIBILITIES OF OFFICE-BEARERS

 

(1)

President:  President shall be the head of the Association.  He/ she will preside over the meetings of the General Body and the Executive Committee.  The President can invite distinguished persons from outside the Association to inaugurate or address the General Body Meeting, if necessary, with the approval of Executive Committee.  He/ she will coordinate the functions of all the office bearers for the smooth running of Association.

 

(2)

Vice-President:  In the absence of the President, Vice-President shall discharge the duties of the President.

 

(3)

General Secretary:  General Secretary shall

a.        maintain the minutes of the General Body Meeting and Executive Committee Meetings.

b.        make correspondence on behalf of Association.

c.        keep and maintain the records of the Association properly.

d.        take action on resolutions passed by General Body/ Executive Committee.

e.        check the financial records prepared and maintained by Treasurer.

f.           prepare Annual Report indicating the activities of the Association for presentation in the Annual General Body Meeting.

g.        perform such other duties as may be entrusted to him/ her by President/ Executive Committee.

h.         sue and can be sued on behalf of the Association.

 

(4)

Joint Secretary (Headquarters):  In the absence of General Secretary, Joint Secretary (Headquarters) shall discharge the duties of General Secretary.

 

(5)

Joint Secretary (Organisation): Joint Secretary (Organisation) shall look into the organisation work of the Association.  He/ she should coordinate among different zones and help Treasurer in collection of subscription etc.

 

(6)

Secretary (Technical): Secretary (Technical) shall organise seminar/ meetings etc. for promoting technical knowledge among its members and also look into the publication work of a biannual Newsletter of the Association.

 

(7)

Treasurer:  Treasurer shall collect the subscription from members and keep the money in the Bank in a joint Account.  He/ she should keep up to date Accounts duly countersigned by General Secretary.  To meet the expenditure, he/ she shall disburse the amount required after getting approval from General Secretary.

 

(8)

Executive Committee Members:  There shall be three Executive Committee Members from Hqs. and one each from six zones.  They can take part in discussion and offer suggestions for betterment of Association.

 

 

 

19.

 

DISSOLUTION

 

 

In the event of dissolution of Association its properties and liabilities shall be kept under Government custody.

 

 

 

20.

 

AMENDMENT OF THE CONSTITUTION

 

(1)

Every motion relating to the addition or alteration of the rules shall be sent in writing, seconded by members not less than three to the General Secretary at least ten days before the General Body Meeting.  Such amendment must be accepted by majority not less than two-third members present provided that more than fifty percent of the total members remain present in the said meeting.

 

(2)

No amendment of the provision of the Constitution of the Association shall be carried out without the approval of the Government in Home Department.

 

 

 

21.

 

GENERAL

 

 

All matters not specifically provided in these rules shall be decided by the General Body and its decision shall be final and binding.
